What is EB-5?

The EB-5 Immigrant Investor Program is a U.S. government program that encourages new investments in job-creating projects.

The EB-5 program was enacted by the U.S. Congress in 1990 in an effort to encourage foreign investment in certain regions of the country in order to create U.S. jobs.

Through this program, foreign investors and their immediate family members have the opportunity to obtain residency status by investing in a business that creates at least 10 full-time jobs for U.S. workers during a two-year period.

Application process

Upon approval of the initial application, which focuses primarily on establishing the legal source of the $1,050,000 investment (known as the I-526 Petition), the applicant and his or her immediate family are eligible for conditional resident status in the United States.

Once the applicant establishes that the $1,050,000 investment was made in the selected project and the 10 full-time jobs were created within the required period (or will be created within a reasonable period of time), the condition attached to the visa is removed and the applicant and family receive permanent resident status in the United States.


U.S. Citizenship and Immigration Services (USCIS) allocates 10,000 EB-5 visas per year, which constitutes 7.1% of the total allocation for employment-based immigrant visa categories in 2022. A total of 6,882 EB-5 visas were issued.


What is the waiting time for the EB-5 visa in 2023?

The 2023 EB-5 visa wait time is in effect (no delays or setbacks), according to the U.S. Department of State's June 2023 Visa Bulletin. The I-526 petition processing time is estimated to range from 24 to 36 months. At the end of this approval processing period, the investor receives a temporary green card for investment in the U.S.".

How many petitions are submitted per quarter?

There were 556 EB-5 investors who filed I-526/I-526E petitions for the first quarter of fiscal year 2023 (October 1, 2022 through December 31, 2022), and 535 investors who filed I-526/I-526E petitions. 526E petitions for the second quarter of fiscal year 2023 (January 1, 2023 through March 31, 2023).

How many visas are approved per quarter?

The approval rate for I-526 petitions typically ranges from approximately 75% to over 80%.


Smart Brickell

Smart Brickell is a mixed-use project consisting of 3 towers. The first and second towers consist of 100 condominium units and 100 condo-hotel units. The third tower, Smart Brickell LUXE, is comprised of 53 condominium units and 78 condo-hotel units. The project also includes approximately 12,000 square feet of commercial space that will be used for a coffee shop, restaurant and retail store.
